What can I do and what are the prohibitions?

As of this Wednesday, November 4, the country will once again have new more restrictive measures, which mainly cover 121 municipalities and which will affect at least seven million Portuguese.

The Government has decided to go ahead with stricter rules, at a time when daily cases of COVID-19 and deaths associated with this pandemic are increasing significantly. Portugal currently has more than 60,000 infected people and has had, during the last seven days, around 25,000 new cases of covid-19.

The new measures are part of the calamity that is now renewed and that will be in force until 11:59 pm on November 15, 2020.

Regardless of where in the country it is mandatory to wear a mask on the street, as long as it is not possible to maintain a distance. Continuous hand washing, the use of a mask and social detachment are still highly recommended.


Are the restrictions the same for the whole country?

No. There are 121 municipalities that will have stricter rules because they are considered places where there is currently the highest transmission of covid-19 infection. I live or work in one of these 121 counties. Am I obliged to continue working remotely?

Yes, teleworking is mandatory, regardless of the employment relationship you have with the company and as long as the functions in question allow it. If the worker is prevented from complying with the remote work regime, this reason must be substantiated with the employer. The Government has not yet clarified what reasons can be invoked for the worker not to adopt the teleworking regime and how to present this justification.

Will I stop receiving a food allowance because I telecommute?

No, payment is still awaited. The clarification had already been made by the Government and, meanwhile, the draft decree-law that was delivered to the social partners provides for this payment. The same proposal, which has not yet been published in Dirio da Republica, also provides for work accident insurance, if the worker has an accident at home during working hours.

Can the employer force me to go to the company and not stay working remotely?

There is still no specific legislation published in this regard, but a draft law that was sent to the social partners, and to which the press had access, establishes that in this case the employer’s refusal to telework must be substantiated and informed to the worker written.

Exceptionally, when the employer considers that the conditions set forth in the preceding paragraph are not met, the worker must inform the worker of his decision, rightly and in writing, and demonstrate that the functions in question are not compatible with the teleworking or the lack of minimum technical conditions for its implementation ”, reads the document referred to which the Lusat agency had access to.

What do companies whose activities can only be carried out in person?

For companies with more than 50 workers and who cannot apply teleworking because the activity involves face-to-face work, they are obliged to apply the time lag to avoid crossings and crowds of workers. My municipality is on the list. Can I leave the street and go to another municipality?

It depends. The renewal of this state of calamity presupposes the duty to remain at home, and citizens must refrain from circulating in public spaces or roads or equivalent to public spaces, says the resolution of the Council of Ministers.

However, there are exceptions and you can move if:

-You must go to work or come home from work.
-Need to take a child or grandchild to school.
– Go to the doctor, hospital and pharmacy.

Can I go to a restaurant or be on the street with other people?

It is not forbidden to go to a restaurant or cafeteria, but there is a limit of six people per table (in fact, the limit is the same for the whole country). More people are only allowed if they all belong to the same household. Still, there are tighter times for catering: they are forced to close at 10:30 p.m. and the store must close at 10 p.m.
Municipalities can decide that these places should close earlier if the local health authority and the PSP have a favorable opinion.
Catering is limited to 50% of capacity, groups are limited to six people or four people in establishments less than 300 meters from a school and in schools. Food places malls.

Can I go to a show or a celebration?

Yes, you can go to the theater or the cinema, but these types of events are also subject to a limit: the cultural facilities close at 10:30 p.m.
As for celebrations, “the prohibition of holding celebrations and other events with more than five people is in force, unless they belong to the same household.” If the celebration in question complies with this rule, you can participate.

Can I travel abroad?

Yes, the borders remain open, however, the Government recommends that you only travel outside the national territory that is considered necessary. Business trips, to help a family member, etc.

Can I be on the street with friends?

Yes, if there are only five people and as long as the distance and mask rules are followed. The Government and health authorities insist that it is a duty of responsibility for each citizen not to contribute to the spread of the virus.
Attention, social gatherings and the consumption of alcoholic beverages in the street are still prohibited and if it is approached by the authorities you can have problems. The prohibition of the sale of alcoholic beverages in the service areas and, after 8:00 p.m., in any store is maintained.

After all, are fairs forbidden?

The decision rests with the local authorities, it is they who determine if fairs and emerging markets can be held.
