The Chega leader announced on Wednesday that he will appeal to the Supreme Administrative Court (STA) to force the president of the Assembly of the Republic to decide on the suspension of his mandate as a deputy during the presidential electoral campaign.

André Ventura, in statements to journalists in parliament, argued that, according to the Regulations of the Assembly of the Republic, it corresponds to the second figure of the State to analyze a request for suspension of the mandate of a deputy, with the same prerogative of requesting opinion to parliament. Commission of Transparency and Statute of Deputies.

The only deputy of the political force of the far-right parliament thus reacted to the initiative on the eve of an opinion of the Christian democrat João Almeida, who advocated the suspension of his mandate as a deputy and the replacement during the electoral campaign, but the PS failed , PSD, BE and PCP, precisely in the parliamentary commission of Transparency and Statute of Deputies.

Ventura added that he also intends to appeal to the Constitutional Court for the Ratton Palace judges to rule “interpretively” on the legislation in question.

Meanwhile, the vice president of the socialist bench Pedro Delgado Alves will now prepare a new opinion on the matter and the deputies will speak again on January 5, the date of the next meeting of the parliamentary commission.

Pedro Delgado Alves, in Tuesday’s meeting, argued that the regime of justified absences of the deputies for “political work” is enough to safeguard Ventura’s situation.

At stake is the Statute of Deputies, which only provides for the suspension of the mandate in cases of serious illness, parental leave and the monitoring of judicial processes, but also the Electoral Law for the Presidency of the Republic, which guarantees candidates the cessation of functions, maintain remuneration, participate in the campaign and suffrage.

Above, in terms of legal hierarchy, are the constitutional principles of equality and representativeness, also invoked by André Ventura to defend his temporary replacement by the “number 2” in the party and on the list by the Lisbon constituency in the Legislative2019, Diogo Pacheco Amorim.

The Chega leader wants to be freed from obligations in parliament “as of January 1, 2021 and until the end of the elections for the Presidency of the Republic, on January 24, automatically considering suspension if there is a second electoral return and the petitioner is a party to this dispute ”.
