António Joaquim, who had been acquitted of all crimes related to the death of the triathlete Luís Grilo, Rosa Grilo’s husband, was sentenced on Tuesday, September 8, by the Lisbon Court of Appeal to 25 years in prison, corresponding to 24 by the crime of homicide and one for the crime of desecration of a corpse.

The court annulled the decision of the court of first instance, concluding that, after all, Joaquim Grilo was involved in the murder, having been the author of the shooting that killed the husband of his lover, Rosa Grilo, in Vila Franca de Xira, in July 2018. For the magistrates, Rosa Grilo could not have committed the crime alone because, in addition to not knowing how to use a weapon (in this case, a 7.65 mm), she would not have the strength to carry the triathlete’s body alone.

“Given that the accused is the owner of the weapon and that she knew how to handle it with skill, unlike Rosa Grilo, who is totally inexperienced in this matter (…), it makes no sense that she was firing such a shot, being able to affirm with the necessary security that the defendant António Joaquim shot “, says the Court of Appeal, quoted by” Correio da Manhã “.

The same newspaper gives more details reported by the judges. António Joaquim would have fired the gun while Luís Grilo was sleeping, having hit the triathlete on the head. Later, both António Joaquim and Rosa Grilo had turned off their cell phones for 20 hours, so that their locations were not recorded, having deleted the conversations they had for two months.

The sentence also modified facts that had been established by the Loures Court, more specifically, regarding the way in which Luís Grilo’s body was transported to Avis. According to the Court of Appeals, the lovers placed a garbage bag on the head of the 50-year-old triathlete, and then “they placed another bag wrapped around Luís Grilo’s right leg, which contained a tattoo.” Then they would have wrapped “the body of Luís Grilo in a quilt and tied it with a rope,” says the sentence, cited by the same newspaper.

Again, the impossibility of Rosa Grilo being able to do everything alone is emphasized. These are tasks of certain difficulty, which require physical strength from those who perform them and which do not sympathize with the intervention of a single person who, in addition to being a woman and having to transport a man with a robust and athletic complexion, with.

Added to this is the fact that the Court considers that the crime was premeditated: “The defendants drew up a plan with insensitivity and indifference for the life of Luís Grilo, persisting in the resolution to take his life.”

Meanwhile, António Joaquim’s lawyer, Ricardo Serrano Vieira, told CMTV that he will appeal the decision. “We are calm and confident that justice will be served in the Supreme Court. This was not a defeat, it was just an obstacle that we will certainly overcome.”
