This Wednesday, the French Public Ministry requested the suspension of three years in prison for the Portuguese driver who drove the bus that was lost in 2017, on a road in France, killing four Portuguese and injuring 28 others.

On January 8, 2017, 32 Portuguese residents in Switzerland, returning from their holidays in Portugal, were traveling in a 40-seater bus en route to Geneva when they fled the highway, an axis that runs through France from east to west and is called “way of death” because of its danger.

The prosecutor pointed out “an accumulation of personal guilt of the driver”, Henrique Beiroto Angelo, a 44-year-old Portuguese who had been accused of involuntary manslaughter and involuntary injuries before the criminal court of Macon (eastern France).

The Public Ministry also requested a fine of 100,000 euros for each of the two legal entities: Angelo Taxi and Rota das Gravuras, respectively the owner of the bus and the transport company, who were prosecuted for involuntary homicide and involuntary injuries for legal persons.

The prosecutor pointed out “professional misconduct of legal entities, based on poor maintenance of the bus and trailer.”

Even before the accident, the bus was traveling at nearly 90 kilometers / hour, a speed considered excessive due to the January ice. Shortly before, the vehicle was traveling at 101 km / h, according to expert reports.

The analyzes also highlighted the weight of the luggage carrier, which would have slowed down braking, as well as excess air in the tires.

The sentence was set for November 25.

The driver and his father, Narciso Ângelo, legal representative of the two defendants, were not present at the trial.
