The State reached an out-of-court agreement to pay 410 thousand euros to the parents of Hugo Abreu and Dylan da Silva, students who died during the 127th Commando course, which has already been approved by the court.

According to the document, to which the Lusa agency had access this Friday, Dylan da Silva’s parents will receive 210 thousand euros in compensation while Hugo Abreu’s parents will receive 200 thousand euros, with the State providing 60 days to make the payment. it refers to the extrajudicial agreement with the defendants of the judicial process with 19 defendants military, which takes place in Lisbon.

The order of the Central Criminal Court of Lisbon, to ratify the agreement, is dated Thursday, November 26 and is signed by the president of the jury, Helena Pinto.

A source linked to the case told Lusa on Friday that the payment of damages will be made before the end of the year.

Hugo Abreu and Dylan da Silva, both 20 years old, died and nine other students suffered serious injuries and had to be hospitalized during the so-called ‘Zero Test’ (first test of the Commandos course) of the 127th Commandos course, which took finished. in the Alcochete region, Setúbal district, on September 4, 2016.

The out-of-court settlement begins by considering that, “regardless of the facts to be proven [em julgamento], there is also an objective responsibility of the State in question “.

“Taking into account the evolution of the negotiations between the parties, the applicable legal criteria and the recent jurisprudence of the higher courts, in compliance with the duty to pursue the public interest, in the sense of managing public goods with respect for justice, equity and rationality and that, at the same time, it is shown that the same amount is adequate to satisfy the rights of the people, also reflecting a difference between the victims, marking the consideration for the days of suffering before death ”, it reads in the out-of-court agreement.

Likewise, the agreement establishes that the families of Hugo Abreu and Dylan da Silva “declare that (…) the State or the defendants should not claim any other compensation in relation to the matter of the compensation claim made in the process, thus waiving to its continuation “.

There were two claims for damages filed by the families: Dylan da Silva’s parents asked for 400 thousand euros while Hugo Abreu’s family demanded 300 thousand euros.

The Public Ministry charged 19 Army soldiers, all from the Commando Regiment, considering that they acted with “manifest contempt for the serious consequences they caused” on those offended during the 127th Commando course.

The eight officers, eight sergeants and three enlisted men, all members of the Army of the Command Regiment, most of them instructors, are charged, in total, with 539 crimes of abuse of authority for violating physical integrity.

The trial continues on the afternoon of December 3.
