The Braga Court today sentenced a young man to three years in prison, with a penalty of suspension, who stabbed another on the terrace of a bar in that city in November 2019.

For the suspension of the sentence, the 21-year-old accused must deliver, within one year, 1,000 euros to the Portuguese League Against Cancer.

The defendant was found guilty of simple attempted murder.

The court decided to apply the special regime for young people, which implies a very considerable reduction of the penal framework.

The events date back to the early morning of November 30, after an argument between the accused and the victim, who was accompanied by about 30 friends.

Still according to the court, the defendant, feeling somewhat intimidated by the number of friends of the victim, took a knife with a blade about nine centimeters long and tried to hit the victim on the chest, but managed to defend himself with his hand. .

The defendant struck three more blows with the knife, hitting the victim in the chest, shoulder and left forearm.

For the court, the defendant “acted out of fear.”

“There was a cauldron there that could explode and the accused was scared, which does not remove both the guilt and the illegality of the conduct,” says the sentence.

The panel of judges highlights that the accused knew he could kill and accepted that possibility.

The death, the sentence adds, simply did not occur because the victim protected himself with his hand, fled and was immediately assisted.

To measure the sentence and the respective suspension, the court, in addition to the age of the accused, also considered the lack of a criminal record, his “sincere” regret and his social and family insertion.

“We believe that it is about giving a new opportunity to the accused and that the special relaxation of the prison sentence will contribute to the social reintegration of the accused,” the sentence affirms.

The court emphasizes that the defendant’s conduct was even “understood” by the offended, who forgave him in court.
