Restaurants and industry begin to separate bio-waste in 2021. Families will do the same in 2023. Municipalities have to change rates and impose fines.

The Government wants to expand the selective collection and separation of bio-waste that will be mandatory until December 31, 2023 in all homes. The remains of food and meals correspond to 40% of the Portuguese garbage bag. In larger restaurants and industries, this obligation is already imposed next year. Municipalities and inter-municipal systems must ensure that the separation is made, but may also fine those who do not recycle.

The measures are reflected in the proposal to change the legal framework for waste management, in public consultation until Friday on the online portals ConsultaLEX and Participa. The Government determines that “all citizens are responsible for separating and depositing urban waste produced in homes at collection points or centers”, which the municipalities will make available. Municipal services “must stipulate specific administrative offenses” in case of non-compliance with this “duty of separation” of waste, and apply a rate that covers the entire cost of providing the service. The Regulatory Authority for Water and Waste Services (ERSAR) will be responsible for monitoring compliance with the new rules.
