It is not the first time (nor the second) that the Lapo restaurant, in the Bica neighborhood of Lisbon, violates the regulations of the state of exception, which provides for the closure of these establishments, and organizes a party with several people. who do not wear a mask or care about physical distance. It happened again on Thursday night, and the PSP, at 10 pm, proceeded to identify and relieve 13 administrative offenses against the citizens who were there, in violation of the general duty of mandatory collection.
According to a statement sent by the PSP’s Lisbon Metropolitan Command (Cometlis), the “event took place in a building on the street where the Lapo restaurant is located, which was closed, and the PSP approached the participants, after leave the building, for the purpose of identification and participation before the competent authorities ”.
At one point during dinner, one of the owners of the space performed a live, through the restaurant’s Facebook page, where he launched the challenge: “Resist is necessary”, while he performed “Grândola Vila Morena”, by Zeca Afonso. “My friends, resistance is necessary. Open your business. Freedom is not requested, it is exercised ”, said the owner, António Guerreiro.
It is no longer the first time that the same restaurant has refused to close its doors. When the new period of general confinement came into force and the restaurant spaces were forced to close, the owners of the Lapo restaurant resisted closing the doors, invoking the Right of Resistance, provided for in article 21 of the Constitution of the Republic Portuguese. That night, they still served meals on the table, but finally decided to temporarily close it. On January 27, they organized a protest near the entrance of the establishment, where about two dozen people gathered, many of them without a mask and without complying with social distance, two of the most basic measures to prevent the spread of the covid- 19.
On that occasion, an official Cometlis source explained that the owners could incur a crime of disobedience. At that time, the agents present at the scene prepared a criminal case for the promoters of the protest for “disobedience because they did not create mechanisms of physical distance, for being in a different place from the one reported and for inciting civil disobedience.” The case was referred to the Public Ministry.
The fines for those who fail to comply with the duty of home collection can range between 200 and 1000 euros for natural persons and between 2000 and 20 thousand euros for legal persons.
