Without having much prominence, in Portugal the revision of the Cinema Law was approved. The Portuguese Parliament approved this controversial bill last Friday (23 October) with the favorable votes of the PS and the PAN.
The highlight is the creation of a new annual fee of 1% for streaming platforms (Netflix, HBO, Disney + and Amazon) and also for the time established for the transmission of pornographic content.

Bill 44 / XIV has already been approved! This proposed law transposes the European Directive (of 2018), which regulates the supply of audiovisual communication services. From now on, Portugal begins to provide for the obligation to pay a 1% fee on the income of streaming platforms such as Netflix, HBO, Disney +, Apple + and Youtube.
According to Public, the proceeds from the collection of this new rate are reverted to the income of the Instituto do Cinema e Audiovisual (ICA). If it is not possible to determine the value of the relevant revenues of these operators, "the annual rate is assumed to be one million euros".

The aforementioned streaming platforms will also have investment obligations in film and audiovisuals in Portugal, similar to what is already happening with other operators.
It is defined that the investment obligation is exercised with "total freedom of choice" and, if it is not possible to determine the value of the relevant income of the operators, the annual investment value is set at four million euros.
In addition to this change, the draft bill now approved defines that the 4% display rate on advertising broadcast on television channels and whose charge reverts to ICA, now includes video-sharing platform services, such as YouTube. . The charge for the subscription fee for television services provided, for example, by NOS, MEO and Vodafone continues.
Another measure refers to pornographic content. With the new law, this type of content can only be transmitted through channels and platforms to share videos between 0:00 am and 6:00 am.
