The Lisbon Court of Appeal reversed the decision of the Loures Court in the case of the death of triathlete Luís Grilo, condemning António Joaquim to 25 years in prison, who had previously been acquitted of all crimes. As for the main defendant in the case, Rosa Grilo, the sentence is upheld. António Joaquim, the man with whom Rosa Grilo had an extramarital affair and who had been acquitted in the first instance, has now been sentenced to 24 years for the crime of qualified homicide and one year for the crime of desecration of the corpse. The defendant, who was a judicial official, was also sentenced to a period of suspension. The Court of Appeals says that “it can be stated with the necessary security that the defendant, António Joaquim, shot.” As for the transportation of the body, they say that “it could only have been the accused António Joaquim,” says the sentence to which the Observer had access.

Even so, António Joaquim will not go to prison immediately because he can still appeal the decision: the prison is only effective after a final decision and the final sentence. As for Rosa Grilo, it is not safe: at first I could not, since there were two courts – Loures and Relação – to make the same decision: to sentence him to the maximum penalty. However, the defense understands that the double rule does not apply in this case because António Joaquim’s conviction “alters all the facts.” In this sense, João de Sousa advanced to the Observer that Rosa Grilo will appeal the decision.

Maximum penalty. Rosa Grilo sentenced to 25 years in prison for the murder of her husband

At the beginning of the year, the court had proven that Rosa Grilo killed her husband, Luís Grilo, and sentenced her to 25 years in prison, maximum penalty provided by law. António Joaquim, who was accused of co-authorship of the murder, was acquitted of that crime and the crime of desecrating a corpse. He ended up being sentenced only to 2 years in prison – with suspended sentence – for possession of a prohibited weapon. A decision now reversed.

Although he was acquitted by the Loures court, the truth is that there were also doubts about António Joaquim. The court acquitted the judicial officer based on the beginning in doubt for the accused, that is, in case of doubt, the defendant is favored. It does not mean that the court was sure that the defendant was not involved in the crime, but “at least there is doubt”, it was read in the sentence of first instance. And that was enough to absolve him.

Judge Ana Clara Baptista stressed that “it is true that the weapon used” to kill the triathlete belonged to António Joaquim and that he “assumed a strange behavior”: from having started going to Rosa Grilo’s house in search of Luís Grilo and spending the holidays with her, to the fact that he himself never found the mistress’s behavior strange. But he acknowledged that “this finding is not enough” to convict him and that “there was not enough evidence at the hearing” that he was involved in the murder. Only then was António Joaquim sentenced to two years in prison, with a suspended sentence, for the crime of carrying a prohibited weapon.

The two defendants were arrested on September 26, 2018, on suspicion of being the authors of the murder of Luís Grilo. But the case was made public a long time ago, when, on July 16, Rosa Grilo reported her husband’s disappearance to the authorities, alleging that the triathlete had gone out to do a bicycle training and had not returned home.

They followed weeks of searches and interviews granted by Rosa Grilo to various media, in which she denied any involvement in the disappearance of her husband, a 50-year-old computer engineer. The case would take a turn when, at the end of August, The body of Luís Grilo was found, with signs of great violence, in Álcorrego, more than 100 kilometers from the place where the couple lived, in Cachoeiras, in the municipality of Vila Franca de Xira. At that time, the raids led to a homicide investigation and, again, Rosa Grilo was giving interviews in which she denied any involvement in the murder of her husband.

The evidence gathered led PJ to conclude that Luís Grilo was shot dead in the couple’s bedroom by Rosa Grilo and António Joaquim, and later abandoned in the place where he was found. The triathlete was reportedly killed on July 15, 2019, for financial reasons: the half a million euros that the triathlete had in insurance – and sentimental.
