The President of the Republic, Marcelo Rebelo de Sousa, vetoed the public procurement law.

In a letter addressed to the president of the Assembly of the Republic, Marcelo Rebelo de Sousa acknowledges the importance of the new law, but raises several questions to justify the non-promulgation – and the consequent return of the diploma to Parliament.

For the President of the Republic, the need to simplify the rules must be accompanied by measures that guarantee the legality of contracts. As he writes in the letter published on the Presidency page:

In these terms, I return, without promulgation, Decree No. 95 / XIV, requesting the Assembly of the Republic to consider:

to. the effects on the contractor and the contractor of the inspection for posteriori illegalities and irregularities detected by the Court of Auditors and, in addition,
second. the guarantee of the presidency of the independent monitoring and inspection commission by a member appointed by the Assembly of the Republic, the prediction of the expansion of the incompatibility of all members with the performance of positions in the economic and social partners, and the additional support of the commission’s role, in terms of articulation with the Court of Auditors and public knowledge of its activity “.
