Under what circumstances is the use of a mask mandatory?

The decree of the Assembly of the Republic, promulgated this Monday by the President of the Republic, Marcelo Rebelo de Sousa, provides for the mandatory use of a mask “for access, circulation or permanence in public spaces and roads as long as the physical distance recommended by the health authorities are impractical ”.

Will everyone be required to wear a mask?

No. The new law stipulates that the use of a mask is mandatory for people over 10 years of age. That is, children under the age of 10 do not need to wear a mask on the street. Other exceptions are also foreseen, namely, for “people who are part of the same household, when they are not in the proximity of third parties”, or people who present a medical statement or medical certificate of multipurpose disability.

At work, is it mandatory to wear a mask?

The new law only provides for the mandatory use of a mask on public roads. For those who work outdoors, a renouncement of the use of a mask is foreseen provided that its use is “incompatible with the nature of the activities carried out by people”.

What about those who do not comply with the new rules?

Anyone who does not wear a mask on the street in the situations provided for by law is incurring an administrative offense, which can be sanctioned with the payment of a fine that ranges between 100 and 500 euros.

Who will supervise the use of masks on the street?

Compliance with the obligation to wear a mask is the responsibility of the security forces and the municipal police, “with a primary role in raising awareness and teaching about the importance of wearing a mask in public spaces and on roads when it is not possible to maintain social distance” .

Will the use of the StayAway Covid app also be mandatory?

No. The use of the StayAway Covid mobile application was left out of this diploma, after the Government requested the “unbundling” of the proposal it had initially presented, due to the controversy generated in Parliament. The measure must be discussed later, after “a deep discussion” and “all doubts are cleared,” explained Prime Minister António Costa. For now, only the mandatory use of a mask advances.

How long will it be mandatory to wear a mask on the street?

The law is expected to enter into force this Wednesday and must be maintained for a “period of 70 days from the date of entry into force.” After that time has elapsed, the mandatory use of a mask will be reassessed and may be renewed.
