Cafes and pastry shops, and other establishments similar to catering, can close until 1 a.m., but cannot accept new entries after midnight, the government explained in a published diploma.

On September 11, when it declared a contingency situation as of the 15th, in the context of the covid-19 pandemic, the Government ordered the closure of the establishments between 8 p.m. and 11 p.m., but gave autonomy to the autarchies to define the closing hours of the establishments, within that interval, as well as opening hours.

But economic operators have expressed interpretative doubts about the opening hours, particularly with regard to the rule that prohibits new customer entries after midnight and that forces to close at 1 in the morning, reveals the Government in the order posted on Friday. in addition to the Diário da República.

“Establishments similar to those of restoration, that is to say, cafes and pastry shops, can close until 1 in the morning and cannot accept new admissions after midnight, the diploma clarifies.

According to the diploma published on Friday, “several” mayors have also raised questions related to the interpretation of the norm on schedules and the responsibilities that correspond to them.

“Until the mayor’s decision regarding the closing time, the establishments in question must close until 11 at night, unless more restrictive hours are already in force,” he clarifies in the diploma.

Nor does the rule apply if it is a restaurant exclusively serving food in the establishment or confectionery for consumption outside the establishment or home delivery, but it cannot supply alcoholic beverages within the scope of its activity.
