‘Batterygate’. Deco files a lawsuit against Apple for the obsolescence of the iPhone 6 – O Jornal Económico

Deco Proteste will proceed with a lawsuit against the manufacturer of smartphones Apple for having programmed the 6 generation iPhones, which include the 6, 6 Plus, 6S and 6S Plus, to become obsolete more quickly, forcing consumers to switch mobile phones.

According to the consumer protection organization, the rights of 115,000 Portuguese consumers harmed by Apple are at stake. The case against the company led by Tim Cook has become known worldwide as ‘batterygate’.

“Euroconsumers, of which Deco Proteste is a part, have been trying to find solutions for consumers since 2017, the date the case was made public, after Apple did not respond for the last three years,” Deco writes in a release.

“In 2020, and after a complaint from Altroconsumo, an Italian counterpart, the Administrative Court of Rome ordered the brand to pay a fine of ten million euros”, while in the United States the technology company avoided a lawsuit for the salary 113 million dollars in a deal.

The consumer organization argues that it has decided to take legal action against the US company “based on European legislation that expressly prohibits unfair, deceptive and aggressive commercial practices, such as planned obsolescence.” According to these same criteria, the amount of compensation should be the repair cost of the battery of smartphones in question and 10% of the purchase price of the equipment, which is equivalent to 60 euros.
