The Criminal Court of Braga will begin to try, on the morning of next Thursday, two guards from the GNR do Sameiro Post, both immediately transferred by the GNR Territorial Command to Braga and Trás-os-Montes, for alleged crimes of abuse of power and violation of secrecy by an employee, upon a complaint, in the parish of Sobreposta, in Braga.
Both have already been accused by the Department of Investigation and Criminal Action (DIAP), of the Public Ministry of the Braga District, for allegedly warning the owner of an illegally operated cafe that he would inspect it and the other threatening ASAE, humiliating the owner. from another establishment in the area that had denounced the competitor, charges that both denied, but were soon transferred, to Braga and Freixo de Espada à Cinta.
Accused of the crimes of abuse of power and violation of secrecy by an employee, the guards should have investigated a complaint that a cafe closed for works was operating clandestinely at the headquarters of a popular football club in the parish of Sobreposta, in Braga.
According to the Public Ministry’s office, one of the GNR guards telephoned the owner of the cafe, warning him that he would go there, which would allow him to close even before the departure of the Sameiro GNR, in addition to retaliating, both guards, on the complainant . and his wife, from a competitive space, humiliating them in front of customers, during the afternoon of May 9, 2018.
The other guard, although the complainant’s cafe was recently fined, entered the establishment, walked from one side to the other, in the reserved area, always pointing out the same flaws that had already been the subject of the evaluations.
According to the prosecution, the GNR, “in a loud voice, opened cabinets and refrigerators”, telling the couple of merchants, in front of all the coffee customers, that “they would have ASAE at the door”, following “what they had already agreed, where , in a loud and aggressive voice, they asked for the documents ”of the cafe and the owners.
For the MP, the two soldiers of the GNR do Sameiro, with such conduct, “acted with the sole purpose of retaliating against the owner of that establishment,” since it was they who filed such a complaint, for which “they violated their duty special exemption ”.
“They abused the control power attributed to them as a criminal police force and with the intention of causing harm to the owner of the establishment, affecting his reputation and humiliating him and his spouse,” says the Public Ministry.
As stated by the Public Ministry, at the date and time of the event, “there was no situation or occurrence within that establishment that justified the intervention and / or inspection carried out by the accused”, who did not raise any file.
GNR guards deny everything
In their defense of the defamation of the prosecutor, the two soldiers, who are defended by the lawyer João Magalhães, deny any public accusation, denying any type of persecution action against the plaintiff, in addition to having abused power.
A guard denies even calling the merchant, making his cell phone available, to confirm the absence of a phone call, through the NOS operator, on the same date and time, to the suspicious owner of the cafe.
The other also affirms that he has not even fined the coffee again, but that he has disciplinary files, both in the General Inspectorate of Internal Administration (IGAI) and in the Territorial Command of GNR Braga.
This GNR do Sameiro Post, directly dependent on the GNR Braga Territorial Detachment, has an extensive area in the Eastern Zone of the Braga municipality, in the Espinho, Sobreposta, Pedralva, São Mamede de Este and São Pedro Este parishes.
