André Ventura advances with summons against the Assembly of the Republic and Ferro Rodrigues – O Jornal Económico

The president of Chega, André Ventura, advanced with a summons against the Assembly of the Republic and Eduardo Ferro Rodrigues this Thursday, December 31.

After the Constitutional Court (TC) accepted Ventura’s candidacy this Wednesday, the Chega leader proceeded with a summons in which he seeks to “provide immediate judicial protection to these situations to respond to the requirements of speed and priority.”

“The purpose of the summons is to guarantee in due time the exercise of the right to civil capacity and citizenship of [André Ventura] provided for in article 26 of the CRP[Constituição da República Portuguesa]And the president of Chega considers that these rights were “limited with regard to access to public office, provided for in the constitutional terms of article 50 of the Constitution of the Portuguese Republic.”

The CRP establishes that “deprivation of citizenship and restrictions on civil capacity can only take place in the cases and terms provided by law, and cannot be based on political motives.”

In the summons, the presidential candidate explains that in “the exercise of his right to citizenship and the development of personality and civil capacity, these rights are constitutionally provided for in art. 26 of the Constitution of the Portuguese Republic, he exercised his right to stand for the presidency of the Portuguese Republic ”. And he saw “his right denied by the president of the RA refraining from behaving [Eduardo Ferro Rodrigues], which hurts you every day ”.

Thus, the Chega leader asks the Supreme Administrative Court to implement “article 20 of the Constitution of the Portuguese Republic, as well as article 109 of the CPTA.” The articles define that “a substantive decision that requires the Public Administration to adopt a positive or negative conduct (..) to ensure the exercise in due time, of a right, freedom or guarantee is promptly issued.” .
