Nos executive president Miguel Almeida guarantees that he has no doubts about the “illegality” of the 5G auction rules approved by the regulator (Anacom). And, to reinforce the warnings he has made in this regard, he cited the opinions of three constitutionalists – Paulo Otero, Vital Moreira and Jorge Miranda – who conclude that the national roaming measure represents an “expropriation of the State in favor of private economic interests”, said. the leader of Nos this Monday in Parliament. In the case of Paulo Otero, his opinion had already been used by the operator in response to the public consultation of the 5G rules.

The basis for these conclusions is the measure of national roaming, which consists of sharing the current infrastructure of operators already installed in the market with new entrants to the market through 5G auctions. The transfer of networks will have to be by mutual agreement, as Anacom has already stressed. But, according to the operators, the measure is “illegal” and violates competition rules. Complaints that have already led the operators to go to court, with precautionary measures, as well as to Brussels.

“The president of Anacom, in his crusade against the sector and the country, insists on the need to eliminate the current operators for the benefit of the new ones,” he began by criticizing Miguel Almeida. A situation that the official has no doubt that could lead to “the replacement of current operators by companies based in Spain” and make “Portugal the eighteenth Spanish autonomous community.”

In addition, he said that “an administrative authority must be politically neutral and cannot make economic policy decisions.” For this reason, he asked Parliament to “promote the abstract revision of the constitutionality of the rules of the regulation.”

Asked about the impact of this regulation on the future of the sector, he said that “so that the sector is not sustainable” and is practically certain that “in 3 or 4 years we have the guarantee of not having 4 or 5 operators. term in a logic of consolidation of the sector ”, a movement that is taking place throughout Europe, he admitted.

So far, the presentation of proposals by new actors is unknown. The only company that showed public interest in participating in the race was the Spanish company MásMóvil, owner of Nowo. However, the former Cabovisão has not yet commented on a possible tender for the auctions, the first phase of the tender, reserved for new entrants, starting on Tuesday December 22, according to Negócios.

Dense Air has already admitted that it has entered the game, but according to the rules approved by Anacom it is not considered a new entrant. This company has spectrum reserved until 2025, but it has to go to auction to maintain or increase it.
