The Competition Court revokes the Banco de Portugal’s decision and acquits KPMG and associates

The auditor KPMG and five of its partners were acquitted this Tuesday by the Competition Court of all administrative offenses for which they were convicted in June 2019 by the Bank of Portugal (BdP), in the field of the BES case.

When reading a summary of the sentence, which lasted about two and a half hours, Judge Vanda Miguel refuted the accusations made by the supervisor, concluding that there was a lack of evidence on the violation by the accused / appellants of the rules that they should have. having led to the issuance of reserves to the consolidated accounts of Banco Espírito Santo (BES).

In June 2019, the Bank of Portugal ordered KPMG to pay a fine of 3 million euros, to its president, Sikander Sattar, of 450,000 euros, Inês Viegas (425,000 euros), Fernando Antunes (400,000 euros), Inês Filipe ( 375,000 euros) and Silvia Gomes (225,000 euros), all of whom appealed before the Court of Regulation and Supervision of Competition (TCRS), in Santarém.

The TCRS today considered “totally valid” the challenge request presented by KPMG and associates, revoked the BdP’s conviction and acquitted all the applicants, a decision that both the supervisor and the Public Ministry announced that they will appeal.
