PAN deputy Bebiana Cunha said today that the party will demand “accountability” to the Viana do Castelo Chamber for acting in “bad faith” by sacrificing more than 20 bananas in Darque, in “lack of respect” for the organs judicial.

“In our legal understanding, there is an act of bad faith, which we have to report,” said the PAN deputy during a visit to Avenida do Cabedelo, in Darque.

“Now we are going to demand the accountability of the City Council of Viana do Castelo for this act that, in our understanding, from the ethical point of view, is unacceptable,” he reinforced, referring to the massacre, by the municipality, the week last, of “more than two dozen bananas” in that artery to build a roundabout, planned for the last phase of access to the city’s seaport.

In October, the PAN advanced a precautionary measure before the Administrative and Fiscal Court of Braga (TAFC) to stop the cutting of those copies.

On November 13, the municipality advanced a reasoned resolution of public interest, a procedure that, according to the mayor, José Maria Costa, “after being communicated to the plaintiff, the PAN, his legal representative, the work contractor and the Braga TAF, it suspended the action, allowing the sacrifice and the resumption of the construction of that highway ”, detained since September.

For Bebiana Cunha, the municipality “did not give anyone who had tried the precautionary measure the possibility to react to justice.”

“The Chamber did not expect that we would be able to request the court to rule on this decision of the Chamber, within the five days provided by law. In our opinion, there is a clear contempt on the part of the Chamber towards the judicial bodies and, therefore, we had to report this fact to the Court. At the very least, there is an act of bad faith on the part of the Chamber of Viana do Castelo ”, he specified.

Bebiana Cunha explained that with the felling of trees, the precautionary measure has already “lost its usefulness”, but said that the PAN will proceed with another judicial process against the municipality of the capital of Alto Minho.

“We will continue with the process, demanding that the City Council of Viana do Castelo be held responsible for this lack of respect for the courts, which is also a lack of respect for the citizens who understood that this work should be reevaluated or that there should be a plan B of sacrifice “, sure.

The PAN deputy explained that accountability could “go through compensating those who feel injured by the loss of that heritage of high natural value, which is not only the residents of the parish, but all citizens.”

“We are studying from a legal point of view, but we do not deny the possibility of proceeding with a claim for damages. The process will be carried out correctly in court and we will do our part. We will continue to collect the necessary data ”, he assured.

Lusa contacted the mayor of Viana do Castelo, but José Maria Costa (PS) refused to comment on the matter.

In the action carried out today on Avenida do Cabedelo, on the left bank of the Lima River, about 20 people participated, including two representatives of “Juntos pelo Rossio” – Associação Cívica de Aveiro.

It is about the slaughter of 24 of the 170 bananas in the 628 meters of the avenue.

Construction of the roundabout resumed on Tuesday. Initially, it was seized at the initiative of residents of that avenue who, however, reached an agreement with the municipality.

The construction of the road accesses to the seaport began in February 2019. The new 8.8-kilometer-long accesses, claimed for more than four decades, will have two 3.5-meter-wide carriageways and represent a investment of more than nine million euros.

The work is financed by the Viana do Castelo City Council and the Duero, Leixões and Viana do Castelo Port Administration (APDL).
