The Council of Ministers approved this Thursday the diploma that adapts the formula for calculating the unemployment benefit, taking into account the reduction of the guarantee period for access to this aid provided for in the Supplementary State Budgets.
The decree-law approved this Thursday and that adjusts the formula for calculating the unemployment benefit in situations of reduction of the guarantee period, also determines the temporary suspension of the duty of exclusivity.
“The diploma allows the reduction of the guarantee periods for access to unemployment benefits and the subsidy for cessation of activity provided for in the Supplementary Budget, and suspends the exclusivity regime in situations of creation of own employment through the amount of the unemployment benefits ”, reads the statement of the Council of Ministers.
The current regime stipulates that in cases in which support is granted for the creation of one’s own job and in which the unemployment benefit is paid in full, the worker may not carry out any additional activity.
The temporary suspension of the exclusivity regime was decided, according to the Minister of State and Presidency, Mariana Vieira da Silva, due to the current pandemic context, which allowed other activities to be carried out.
The rules governing unemployment benefits require a guarantee period (that is, a period of discounts) of 360 days in order to benefit from this support, but in the Complementary EO this period has been reduced to a minimum of 180 days.
“The unemployed have the right to work between 180 days and 360 working days for others, with the corresponding salary record, in a period of 24 months immediately prior to the date of unemployment”, and who have been without work in period of situations emergency and disaster.
This reduction in the guarantee period remains in force until December 2020, “the respective beneficiaries are transferred, as of January 2021, to the unemployment benefit”, and this transition is carried out without conditions of resources.
The measure that reduces the period of guarantee of access to unemployment benefit also includes the self-employed who concentrate more than 50% of their activity in a company, and who, therefore, are classified as economically dependent.
“Beneficiaries who have 180 days of autonomous economic activity, with the corresponding effective payment of contributions, are entitled to a subsidy for cessation of activity, within the period of 24 months immediately prior to the date of involuntary termination of the contract of provision of the service and that its activity ceased during the period of a state of emergency or a state of public calamity “.
The Government also approved today the final version of the diploma that modifies the solidarity supplement regime for the elderly, expanding to the third step the elimination of the impact of children’s income in the allocation of maintenance and defining the creation of a simplified mechanism that waives payment. Initial drug cost not reimbursed by the State.
