Entrepreneurs with a turnover of 25% or higher will be able to reduce the working day between October and December by up to 33%, depending on the change to the progressive recovery regime for companies in crisis.

The decree-law published in the Diário da República entered into force this Tuesday, October 20 and came to alter the extraordinary support for the progressive resumption of activity in companies in a business crisis situation with a temporary reduction of the normal work period, created on last August.

The maximum limits for reducing working hours are modified by decree-law, creating the possibility that the employer with an interruption in billing equal to or greater than 25% may reduce it to a maximum of 33% from this month and up to December.

The regime created in August provided only for schedule reductions for billing interruptions equal to or greater than 40% and equal to or greater than 60%.

The amendment published today adds, in addition to the 33% reduction limit for billing losses equal to or greater than 25%, a 100% reduction limit in the SOP for employers with a billing loss equal to or greater than 75%, between October and December.

The Institute for Employment and Professional Training (IEFP), and the competent Social Security, will proceed, in accordance with the decree-law, “to verify the possible undue accumulation of support, simultaneous or sequential, through the unofficial exchange of information.”

The diploma also determines that, as of August 1, and for inspection purposes, the reduction of the normal work period is measured in average terms, per worker, at the end of each month, with respect to the maximum limits of the period. daily and weekly rates provided for in the Labor Code or in an applicable collective labor regulation instrument.

In the preamble to the decree-law published today, the Government explains that the extraordinary support for the progressive resumption “is subject to permanent evaluation, that is, in terms of its coverage and its effectiveness in responding to the serious circumstances that a party is going through. relevant of the agents “of the labor market.

The purpose of changing this support, he specifies, is to “better calibrate” this instrument, “strengthen support” for the most difficult employers, “extend access” to more employers, improve coverage and “strengthen incentives” for training.

The diploma modifies the maximum limits to be observed in the reduction of the normal working period, the rules applicable to the determination of the remuneration compensation to workers and the support regime granted by Social Security, the concept of business crisis situation considered in the scope of the measure and, in addition, the complementary support that will be granted within the framework of the complementary training plan.

The revision of the concept of business crisis situation aimed to expand the access of more entrepreneurs to the measure, beginning to allow the application of the measure by entrepreneurs with turnover losses equal to or greater than 25%, establishing in this case a maximum limit reduction of the PNT 33% which, according to the executive, intends to “preserve proportionality” in the relationship between the situation of business crisis and the applicable limits on the reduction of the PNT.

The diploma also modifies the regime of the complementary training plan, increasing the value of the scholarship to which employers and workers are entitled and establishing that the training plan must ensure at least 50 hours of training.

The support regime for the progressive resumption of activity was the instrument that, in August, replaced the simplified dismissal.
