According to the MP, the defendant has a “dissatisfied” personality, having not shown pity for the situation, but the confession of the facts and the age factor (22 years) must be taken into account by the court.
The prosecutor added that the death of a child did not occur only by “mere chance” and because there was the intervention of some people, stating that “the testimonies were enlightening.”
For the defendant’s defense, it is a crime of infanticide (when the woman kills the newborn who gave birth during or after childbirth and is still under its disturbing influence).
“We understand that it is a crime of infanticide in the form of intent. In my opinion, it is difficult to put this situation aside, it must be taken into account ”, said lawyer Rute Alexandra Santos, challenging the request for sanction from the Public Ministry.
According to the lawyer, Sara Furtado should be subject to a “minimum prison sentence”, once she confessed the facts, had psychiatric consultations and is learning a profession.
The woman is in preventive prison, accused of the practice of qualified murder in the tentative way.
The reading of the sentence was scheduled for October 21, at 12:00 hours.
On the afternoon of November 5, 2019, the authorities received the alert about a newborn found in a garbage dump on Avenida Infante D. Henrique, near the river station in Santa Apolónia, and next to a nightlife establishment. .
The newborn was found by a homeless person, still with traces of the umbilical cord, and was transferred to the Doña Estefânia Hospital, in Lisbon.
After being admitted to the pediatric emergency unit, he was transferred to Maternidade Alfredo da Costa for not needing complex medical and surgical care.
According to the Lisbon District Attorney General, “it was sufficiently indicated that the defendant, who was 36 weeks pregnant and in labor,” gave birth to the baby in Santa Apolónia, “and placed the newborn in a plastic bag, along with the other tissues expelled at the time of delivery, and they placed it inside a yellow ecopoint, and then left the place ”.
At that time, the president of the Institute for Child Support (IAC) defended that the young woman exposed the baby to abandonment without wanting to kill him.
