Telecom operators must block child pornography

In August of this year, the Penal Code and the Electronic Communications Law underwent changes. The filters are now mandatory, after indicating the services of the Attorney General's Office, which must assume the responsibility of listing the different addresses and content of pornography with minors that should be prohibited to Portuguese Internet users, said the Jornal Expresso at that time .

The amendments approved by Parliament do not allow the blocking of content without the proper request of the PGR, but it obliges the telecommunications operators and platforms present on the Web to inform the authorities every time they detect pornographic content with minors under 18 years of age.

Fines can reach 100,000 euros for operators who do not block content referenced by the authorities. The legislative update also provides a maximum sentence of three years in prison for anyone who promotes the dissemination of child pornography on the Internet. Parents and guardians who commit this type of crime with minors between the ages of 14 and 18 can be sentenced to eight years in prison. The penalty is aggravated by an increase of half the time provided for crimes under 14 years.
