José Miguel Ferreira da Costa, the 22-year-old who killed his father, António Ferreira da Costa, shot in Moure, Vila Verde in 2017, surrendered himself this week to the Braga prison to serve two and a half years in prison. four years and one month to which he was sentenced, for the crime of simple homicide, by the Court of Braga.
The defendant, who had already been under house arrest, appealed the sentence to the Guimarães Court of Appeal, but the appeal was rejected.
The sentence, of March 2020, also involved the victim’s widow, Maria Júlia Alves Ferreira, who was sentenced to 490 euros in fine for simulated crime.
In the appeal, lawyer Artur Marques requested that he be convicted of the crime of privileged homicide with a penalty of no more than eighteen months in prison, “which must be declared completed, since the accused is subject to preventive detention followed without interruption. , of the obligation to stay in the home, from September 21, 2018, for 19 months ”.
The fight that led to the crime
The first instance sentence describes the fight between José Miguel and his father: “at lunchtime there was an argument between the defendants – the victim’s son and wife – and António Costa, for reasons related to the harvest, who threw a plate to the defendant, telling him that he spoke very loudly and then grabbing her ”.
“This attitude did not please the defendant who, therefore, intervened and told his father:” do not hit my mother again. “
This, in turn, “true to his irascible personality”, responded by saying: “one day you will leave here with a knife stuck in your head.”
The same day, after lunch, the defendant damaged a gimbal of the tractor he was maneuvering.
Then there was a violent discussion between the defendants and the victim, who told her son: “You are a son of a bitch, get out of here and I don’t want to see you here anymore.”
“It was then that the defendant, disturbed by the discussion, killed his father.”
