President Duterte appointed another appeals magistrate, Ricardo Rosario, as an associate justice of the Supreme Court.
Rosario was sworn in before Supreme Court President Diosdado Peralta around 3 pm on Friday.
Several Supreme Court magistrates, the presiding magistrate of the Court of Appeals (CA) Remedios Salazar-Fernando and the CA magistrate Fernanda Lampas Peralta were witnesses of his oath.
Rosario, president of the CA’s Ninth Division, seven nominees from the Judicial and Lawyers Council (JBC) for the vacancy created by the retirement of Associate Supreme Court Justice José Reyes Jr. on September 18.
The other nominees were CA judges Ramon Cruz, Japar Dimaampao, Jhosep Lopez, Eduardo Peralta Jr. and Ma. Filomena Singh and the court administrator, José Midas Márquez.
Rosario was previously nominated by the JBC for the Supreme Court seats left vacant by the retirements of Associate Justices Andrés Reyes Jr. and Antonio Carpio, and the elevation of Associate Justice Lucas Bersamin as president of the court.
With Rosario’s appointment, there are now 11 judges on the 15-member high court who are appointed by Duterte. This excludes Peralta, who, although appointed Chief Justice by Duterte in October last year, was first appointed Deputy Judge by President Gloria Macapagal-Arroyo in January 2009.
This year, the President also appointed Deputy Justices Samuel Gaerlan and Priscilla Baltazar-Padilla in January and July, respectively. So far he has appointed three senior judges.
Duterte has appointed a total of 15 new members to the Supreme Court, four of whom have retired.
Rosario earned her law degree from the Ateneo de Manila University in 1983 and passed the bar exams the following year.
He began his legal career as a legal officer for the National Investigation Office from 1985 to 1986, after which he served as a senior corporate attorney for the Metropolitan Water and Sewerage System.
In 1994, he was appointed Chief Deputy Prosecutor for the City of Quezon City, and served until 1997, when he was consecutively appointed as a judge of the Metropolitan Court of First Instance of Manila and a judge of the Regional Court of First Instance of Makati City.
Rosario was appointed a member of the CA in September 2005. He wrote the CA ruling in 2018 that refused to stop the government’s selection process, which awarded the third position of telecommunications provider in the country to a consortium led by the businessman.
