MANILA, Philippines – The Bureau of Immigration (BI) said Wednesday it will implement a deportation order against US Navy Corporal Joseph Scott Pemberton after President Rodrigo Duterte granted him a full pardon.
In a statement, BI commissioner Jaime Morente said that he already asked the director general of the Bureau of Corrections (BuCor), Gerald Bantag, to hand over the US military to the BI the moment he leaves prison so that their deportation can be implemented and their departure from the Philippines organized and facilitated.
The BI said its commissioners office issued the order against Pemberton on Sept. 16, 2015 for being an undesirable alien.
Pemberton, who was convicted of manslaughter for killing a transgender woman Jennifer Laude in 2014, received an outright pardon from Duterte on Monday.
Morente, for his part, said the clemency granted to Pemberton means there is no further legal impediment or obstacle to Pemberton’s departure from the Philippines.
“In any case, we are awaiting instructions from our Secretary of Justice, Menardo Guevarra, to guide us on how we will implement the deportation order in a way that is within the laws prescribed in the country,” Morente said.
The head of BI’s Legal Division, Arvin Santos, explained that foreigners who are going to be deported must present authorizations from the National Investigations Office, as well as from the regional court of first instance, as proof that they do not have more criminal cases or pending civilians.
