MANILA – The House Justice Committee could address the impeachment lawsuit against Deputy Supreme Court Justice Marvic Leonen “next year,” according to a senior panel member, as lawmakers won’t have time enough to deliberate on the matter ahead of schedule. vacation break.
The vice president of the House Justice panel and vice president, Rufus Rodríguez, told reporters Thursday that the complaint filed on Monday has not yet been forwarded to them.
“[W]We will already have our recess sometime on December 18, so we will not really have material time … It will probably come next year for the determination of the form and substance, “said Rodríguez.
According to the rules of the House, the Spokesperson shall include the complaint on the Agenda within 10 days of session from receipt after verification. It will then be sent to the Justice Committee within a three day session ”.
The Justice Committee will then deliberate and vote on the complaint to determine sufficiency of form, substance, basis, and probable cause.
A complaint lacking any of these will be presented by the committee to the full House for final dismissal. A complaint that exceeds 4 hurdles will be submitted to the plenary session for final approval. If the complaint obtains the vote of 1/3 of the legislators during the plenary session, the complaint goes to the Senate to be judged.
However, Rodríguez admitted that the president of the Justice panel, Leyte, Rep. Ching Veloso, would still be the one to decide if the hearings would take place this year.
Leonen, who will retire from the high court in 2032, faces impeachment brought by private plaintiff Edwin M. Cordevilla, secretary general of the Philippine League of Good Governance Defenders or FLAGG, with once suspended attorney Larry Gadon. .
The complaint has been endorsed by the 2nd deputy of Ilocos Norte, Angelo Barba, cousin of Senator Imee Marcos and former Senator Bongbong Marcos, whose electoral protest against Vice President Leni Robredo remains pending in the Presidential Electoral Tribunal.
The Supreme Court acts as PET and Leonen is a member in charge of the case.
The PET recently rejected Bongbong Marcos’ appeal seeking Leonen’s inhibition of the electoral protest.
Leonen is one of the three remaining individuals appointed by then-President Benigno Aquino III to the tribunal, the others being Senior Associate Justice Estela Perlas Bernabe and Associate Justice Benjamin Caguioa.
