Garcia sues 2 doctors from Chong Hua

Governor Gwendolyn García’s family filed criminal charges for medical negligence against two doctors on Tuesday, December 15, 2020, for the death of Barili Mayor Marlon García.

Dr. Elfleda A. Hernandez and Dr. Yvonne Bettina E. Montejo were named defendants in the complaint filed with the Cebu City Attorney’s Office.

The announcement of the indictment was made by the family at a press conference on Wednesday, December 16. It was attended by relatives headed by the patriarch, former representative of the Chamber and Governor Pablo García.

The medical malpractice charge against Hernández and Montejo was based on the findings of Dr. Ravi Durvasula, a licensed physician and professor of Medicine and Infectious Diseases and chair of the Department of Medicine at the Loyola University Stritch School of Medicine in Chicago, USA. USA

No irregularities

Hernández and Montejo have not yet released a statement, but Chong Hua Hospital said Wednesday that there were no irregularities or deficiencies “in the way we had cared for the late Garcia brothers, or any of our Covid-19 patients.”

Durvasula’s findings showed the failure to adhere to standard care and procedures, the use of highly questionable and unnecessary laboratory tests and treatments, and the exaggerated or unfounded laboratory results that led to the death of the late mayor.

Aside from Durvasula’s affidavit, which she testified to the City Attorney’s Office through Zoom, she also submitted supporting affidavits from Jima Tiano-García, Marlon García’s widow, Governor García, attorney Winston García , Farla Carolyn García and the Mayor of Liloan Ma. Esperanza Christina García-Frasco.

“The complaint is the first in a series of complaints that the family plans to file against the two doctors and the hospital, not only for the death of the late Marlon F. García but also for the death of the late Nelson F. García,” said the Garcia family statement released Wednesday.

The family is awaiting the final report on the findings of its medical experts investigating the death of the late Nelson Garcia before taking action on his death.

Lawyer Joan Largo, a lawyer for the García family, said that one of the reasons the family files the complaint is the hospital’s contradictory statement about the García brothers’ condition and their medical records.

“Because if you look at their lab results, these would have been the results of someone who is very seriously ill or on the verge of death. But already on August 24 he was feeling better, he was sending a text message to Mayor Christina telling her that he wanted to be discharged from the hospital … he said he was willing to sign any resignation, ”Largo said.

The family also plans to seek damages against Chong Hua Hospital for the deaths of brothers Marlon and Nelson Garcia, and to file criminal charges for fraud by falsifying documents resulting from their fraudulent reimbursement claims from Philippine Health Insurance Corp. (PhilHealth ) in the death of the García brothers.

The Garcia family in a statement said the hospital made it appear that the two brothers were cared for by no less than 15 doctors, but that was not supported in the medical and clinical records of both patients.

“The family believes that the proper standard of care and treatment for the Marlon and Nelson Garcia patients was ignored and / or overlooked in the selfish desire of the surveyed physicians and the hospital to maximize their profits. Costly and unnecessary treatments, laboratory tests and medical procedures and protocol procedures were used to justify their exorbitant charges, ”the Garcia family statement said.

Chong Hua reaction

In reaction to the allegations, Chong Hua Hospital said that while it has yet to study the family’s statements: “It goes without saying, however, that we categorically deny any irregularities or deficiencies in the way we have cared for the deceased. García brothers, of our patients with Covid-19 “.

“Our treatment protocols comply with the internationally accepted and revised guidelines of the global medical community,” the hospital statement said.

The hospital said it will release an official statement after processing and examining the allegations.

The Garcias were billed P5.2 million for Marlon’s treatment and P3.8 million for Nelson’s treatment.

Attorney Winston García, president of the CFI Cooperative of Cebu, previously asked his members not to visit the hospital due to the bad experience of the family.
