The 9 police officers will also face a charge for placing evidence under the Law for the Comprehensive Regulation of Firearms and Ammunition (art. 38, RA 10591) after prosecutors discovered that they “deliberately placed and placed” a firearm “near Major Indammog’s left hand, who was right-handed. “
“The qualitative test for the presence of gunpowder nitrates performed (after the shooting incident) on Major Indammog’s hands was negative. This indicates that the respondents placed the firearms to cover up the intentional murder of the victims, ”said the DOJ.
However, the Justice Department’s panel of prosecutors dismissed the complaint of negligence of duty for reasons of command responsibility against 3 high-ranking police officers who were the superiors of the 9 police officers.
The panel said that under EO 226, Colonel Michael Bayawan, Jr., Major Walter Annayo and Captain Ariel Corcino must be held “administratively responsible,” which is outside the jurisdiction of Justice Department prosecutors.
The Secretary of Justice, Menardo Guevarra, ordered Malcoltento to immediately present the criminal charges in court and secure the arrest warrants against the 9 policemen “as soon as possible.”
“I understand that the accused police officers have been removed from the service, so the court must immediately obtain jurisdiction over their person, so that they cannot flee,” Guevarra said.
The charges against the 9 police officers are not subject to bail, which means that they cannot take bail as a matter of law, but they must go through court hearings to show that the evidence against them is not solid and convince the judge of that allows them to pay the deposit.
Malcontento said the charges will be filed in a Jolo court as soon as possible.
“Of course, we have to consider travel,” he said.
