Berge Zobayan’s attorneys, listed as successors of interest to pilot Ara Zobayan, allege that “any injury or damage to the plaintiffs and / or their decedent was caused directly in whole or in part by the plaintiffs’ negligence or fault and / or your deceased. ” according to the 7 page document.
“And that this negligence was a substantial factor in the cause of his alleged damages, so this defendant has no responsibility,” says the response.
Zobayan’s attorneys transfer “negligence, fault or unlawful conduct of third parties, whom the responding defendant did not control and had no right to control.”
Among other requests, Berge Zobayan’s lawyers request a trial in his favor and that the lawsuit be dismissed.
The complaint held Island Express, the helicopter company and Ara Zobayan responsible for the accident, citing numerous charges of negligence.
Island Express had no comment Monday and a company representative previously told CNN that it does not comment on the ongoing litigation.
Arthur Willner, a lawyer for Berge Zobayan, told CNN that the man is the pilot’s brother and that the lawyer had no further comment. CNN’s request for comment to Vanessa Bryan’s representatives received no immediate response.
The response, filed on Friday, also said that Berge Zobayan denies all the allegations in Vanessa Bryant’s lawsuit. A test date has not been scheduled.
Other lawsuits from families who lost someone in the accident do not mention Zobayan as a defendant.
The attorney representing the Mauser and Altobelli families filed damage claims alleging that Island Express Helicopters was negligent and careless.
The helicopter crashed into mountainous terrain in foggy conditions on January 26. He was transporting passengers to the Mamba Sports Academy in Thousand Oaks, California, for a youth basketball game when he fell in Calabasas.
The victims also included Payton Chester, 13, and Sarah Chester, 45.
