OBERSTDORF / OSLO (VG) Norway is working to file an appeal after Johannes Høsflot Klæbo’s gold disqualification in five miles. Longtime jury member Torbjørn Broks Pettersen says the burden of proof rests with the Norwegian Ski Association.

– Now the Norwegian Ski Federation can file an appeal and has 48 hours, that is, at 3.30 pm on Tuesday. Then the FIS (International Ski Federation) will establish an appeals commission, with the chairman of the rules committee and two members. Naturally, there will be neither Russians nor Norwegians, explains Broks Pettersen to VG.

Bolshunov’s staff split in two after he and Klæbo met in the race. Klæbo called first on goal, but was ruled out and Emil Iversen finished with the gold. Bolshunov couldn’t ask what he was good at with a stick.

Pierre Mignerey, FIS race director, says the jury concluded that the accident was Klæbo’s fault, as Bolshunov was the first.

– The situation arises because Klæbo tries to pass through a place where there is not enough space, says Mignerey.

Three possibilities

Norway’s first protest was rejected and now cross country manager Espen Bjervig warns that they are working with lawyers to draft the appeal Broks Pettersen is referring to.

According to Broks Pettersen, the burden of proof now rests with the Norwegian Ski Association: they must present evidence that the jury’s decision was incorrect.

1) That they were next to each other and that, therefore, it was a supposed “racial incident”.

2) That Klæbo comes from behind and breaks the rules.

3) If the Bolshunov himself deliberately sought the situation and wanted to block Klæbo.

– The Norwegian Ski Association must show why there is more speaking in favor of Norway’s opinion than what the jury concluded, says Broks Pettersen about this dramatic situation:

Broks Pettersen also says that the FIS commission has 72 hours to process the appeal, and the veteran jury says that one aspect may be particularly important:

– Was an unofficial list of results published? If not, it has not happened that the jury has backtracked. If the jury published the list as it was above the finish line and was later changed, it would be a factor for Norway in an appeal situation. If they cap all results and publish nothing, Norway has a worse case. Because then the jury has never changed their mind, explains Broks Pettersen.

He stands out so much that he is a colleague of all the members of the jury as that he only follows the drama from outside.

Pierre Mignerey says that he does not remember the last time such a situation occurred in a championship, but he mentions the case of Anamarija Lampic on this season’s Tour de Ski.
