US President Donald Trump says a new Texas election lawsuit is “the biggest” in his fight to reverse his loss to Joe Biden.
The lawsuit in question is led by Texas Attorney General Ken Paxton and has won the support of attorneys general in 17 Republican states, and the US Supreme Court has indicated that it will be resolved quickly.
Paxton’s plan is to sue Georgia, Michigan, Pennsylvania and Wisconsin in the United States Supreme Court.
It maintains that the states in question “took advantage of the Covid-19 pandemic” to enact “last minute changes” to their electoral rules, “skewing” the outcome of the elections.
Professor Rick Hasen, an electoral law expert at the University of California, said Paxton’s lawsuit may be “the dumbest case I have ever seen brought as an emergency in the Supreme Court.”
“What absolute garbage. Dangerous garbage, but garbage.”
The only fundamental problem with the case, according to legal experts, is that Texas does not have the ability to bring Paxton’s claims in court, because it has no say in how other states conduct their elections. Pennsylvania can’t sue Texas if it doesn’t like the way that state’s system works, and vice versa.
The Supreme Court has requested responses to Paxton’s filing by tomorrow, suggesting that this case will move forward very quickly.
We have already had one of those responses, a brief submitted by the 17 Republican attorneys, in support of the Texas position.
“The accusations raise important constitutional questions,” the brief argues.
“They also raise serious concerns related to electoral integrity and public confidence in elections.
“These are issues of great public importance that deserve the attention of this court.”
That brief does not change any of the legal arguments, but it adds a little more weight to Paxton’s request.
Experts are convinced the lawsuit will fail quickly, but Trump clearly remains hopeful.
