John-Boy Rakete was on the run for nine days after cutting off his electronically monitored ankle bracelet.

A gang member who struck a man in a gas station yard, contributing to his death more than a year later, cut off his electronically monitored ankle bracelet to attend a “gang event.”

John-Boy Rakete hacked the device on November 8, and police detained it nine days later.

The 27-year-old took off his ankle bracelet so he could go to a “gang event,” Judge Michael Turner told Dunedin District Court on Tuesday.

Rakete’s attorney indicated that he would plead guilty to violating his conditions of release, but the defendant exclaimed from the dock that this was not the case.

The outburst caused a brief postponement, before the man’s lawyer informed him that he wanted to be sentenced on the spot.

Judge Turner pointed to Rakete’s strong criminal record and sentenced him to three months in jail.

Rakete, who has ties to the Mongrel Mob, assaulted Nigel Landreth on the Mobil Forbury esplanade in Dunedin on July 7, 2018. Landreth was hospitalized and died on September 22 of the following year.

Rakete stopped people from giving Landreth first aid, then poured a drink can on his face as he lay unconscious.

Rakete was accused of causing serious bodily harm with reckless indifference and was later imprisoned for two years and two months.

He could not be charged with Landreth’s death because the attack occurred more than a year before his death. The death occurred outside the limit of one year and one day on which a person could be held criminally responsible for a murder.

Since then, the corresponding section of the Crimes Act has been repealed.

Rakete was released from prison in September and ordered to submit to an electronic check.
