Auckland landlord invaded a tenant, then dumped his belongings 11 km away

A riot between an Auckland landlord and the tenant of his caravan ended with the tenant’s belongings being dumped on a road.

The “dispute” between landlord Karen Bartlett and her tenant Natalie Heywood ended in Lease Court, where both women were ordered to pay money to the other.

Court Judge John Greene said the rent in Snells Beach “did not go well” and ordered Bartlett to pay Heywood $ 1,525. Heywood was also ordered to pay Bartlett $ 305.

In May 2019, Heywood rented the caravan from Bartlett, but by September of that year it had been invaded, the court heard.

When Bartlett issued the burglary notice, he also took all of Heywood’s belongings and dumped them on a road seven miles away.

He also changed the locks on the caravan.

The police got involved and Heywood submitted a request for compensation to the court. Bartlett then cross-applied.

Heywood alleged that Bartlett had harassed her, illegally entered the caravan, thrown her belongings away, and generally intimidated and belittled her.

Bartlett claimed Heywood owed a week’s rent, as well as compensation for leaving a microwave outside, repairing a broken window, the cost of changing the locks, reimbursement for storing and transporting belongings, and disposing of garbage.

Greene said Bartlett’s actions to clean up and dump Heywood’s belongings were “inappropriate and insensitive.”

“That said, each party would like me to think that they are innocent victims of the other party’s misbehavior.

“I highly doubt it. Chances are, each one acted badly during the lease, each in different ways,” Greene said in his decision.

Changing the locks had been a failure on Bartlett’s part, Greene said, and claiming to pack, store and then transport Heywood’s belongings for disposal was “audacious in the extreme.”

Claims to get rid of the trash and fix the window were also rejected, as Greene said that Bartlett had illegally seized the caravan.

Greene awarded Bartlett $ 305 for rent, microwave replacement and seagrass removal.

Bartlett had committed multiple illegal acts, Greene said, including illegally entering Heywood, taking possession of the caravan, harassment by searching Heywood’s property, violating Heywood’s right to privacy, and improperly disposing of the property. .

“The tenant suffered some losses and I accept that the circumstances in which her tenancy ended caused her anxiety and inconvenience.”

Heywood received $ 1,500 in exemplary compensation, damages, and bail.
