Home Detention Canceled for Northland Man with End-Stage Cancer

A man in his 30s who dies of cancer has been released from home detention on compassionate medical grounds.

Armand Ameal Jarom Pene, 34, was serving a six-month house arrest sentence for a series of driving-related offenses.

He has terminal lung cancer and appeared in a wheelchair in August for sentencing.

But in Whangārei District Court on Wednesday, Judge Greg Davis said that Pene’s condition had deteriorated further and that no one knew how much longer he had to live.

“It looks pretty bleak from what I’m reading,” Judge Davis told the court, where Pene’s absence was excused.

The judge canceled the sentence of home detention on compassionate medical grounds and ordered that no further sentence be imposed.

“The main thing is that you focus on your health as much as you can,” Davis said.

Penis was sentenced after admitting 11 counts: six counts of driving while disqualified, and one count of driving under the influence of drugs, dangerous driving, refusing to provide a blood sample, failing to stop and possession of methamphetamine.

However, he still denies three more serious charges of possession of methamphetamine for supply, possession of a methamphetamine utensil and illegal possession of ammunition.

Penis will reappear in court on those charges on March 11, 2021, but it is unclear if he will live long enough for a trial.
