Advance NZ leaders have failed in their urgent legal efforts to prevent Newshub Nation from airing an upcoming debate without including the party.
Jami-Lee Ross and Billy Te Kahika, the co-leaders of Advance NZ, earlier this week filed a request for an urgent interlocutory injunction in Auckland High Court against Mediaworks after the party was not included in the multi-party group. Newshub Nations “Powerbrokers”. ‘Debate “.
The debate will include David Seymour from Act, Marama Davidson from the Greens, Winston Peters from New Zealand First and John Tamihere from the Maori Party.
Ross warned that not including the party would cause it “serious harm” and said it was important for Kiwis to listen to a variety of political parties before elections.
Mediaworks, however, said its criteria for participation have been in effect since July and are leaders of parties that have won seats in the last two legislatures.
Judge Walker considered whether there is a “prima facie case that Mediaworks’ standard is unreasonable and arbitrary or irrational (or its application is).”
Finally, it concluded that Advance NZ “has not convinced me that there is a prima facie case that the standard applied by MediaWorks is unreasonable or arbitrary.”
“Even if the threshold is reached, I am not convinced that the balance of convenience favors the granting of provisional measures.”
Therefore, the precautionary measure was rejected.
A Mediaworks spokesperson said: “We are happy with the outcome. The Newshub Nation Powerbrokers discussion will continue as planned and will air on October 3 at 9:25 am on Day Three.”
Ross responded to the decision by calling it “disappointing” for Kiwis who deserved “to hear a variety of ideas and perspectives in the run-up to the elections.”
