GEORGE TOWN: A woman and her boyfriend have been sentenced to death in Superior Court here for the murder of their five-year-old son.
Supreme Court Judicial Commissioner Ahmad Shahrir Mohd Salleh said that R. Saravanan Kumar, 30, and T. Gayathry, 36, would be sentenced to death.
“They should be hung around the neck to death,” he said when sentenced under Section 302 of the Penal Code for murder on Thursday (September 24).
JC Ahmad Shahrir said that the prosecution had proven the case beyond a reasonable doubt.
“The alibi provided to the first defendant, Saravanan Kumar, that he was not at the crime scene is inadmissible as the witness statement was not included in the criminal prosecution code.
“For the second defendant, Gayathry, it is not likely that as a mother she would not take action to protect her son, her own flesh and blood, even if it meant putting her life in danger,” she said.
Saravanan and Gayathry were jointly charged with the murder of S. Kaviarasan, then five, between 8 a.m. From September 20, 2014 and 4:15 p.m. M. From September 27, 2014, at a Taman Keladi home in Kulim, Kedah.
The charge under article 302 of the Penal Code was read in conjunction with article 34 of the same law, which carries a mandatory death sentence upon conviction.
Kaviarasan’s body was found wrapped in a blanket and dumped on an oil palm farm in Bukit Tengah, Butterworth, on September 29, 2014.
Saravanan was represented by V. Parthipan while Gayathry was represented by Gabriel Susayan.
Assistant District Attorney Yasinnisa Begam Seeni Mohideen prosecuted the case.
