Unemployed man pleads not guilty to raping and sodomizing a woman

JOHOR BARU: An unemployed man pleaded not guilty before the Sessions Court and the Magistrates Court to the six charges against him, including raping and sodomizing a 30-year-old woman.

S. Dinesh Kumar, 32, who previously worked as a van driver, was first charged with two crimes before Sessions Judge Mabel Sheela Victor Muttiah here on Wednesday (November 18).

It is alleged that he committed the crime along Jalan Persisiran Perling in Taman Perling here around 6 am last Thursday (Nov 12), which is a crime under Section 376 (1) of the Penal Code.

The crime carries a maximum of 20 years in jail and flogging when convicted.

Dinesh Kumar was also charged with sodomizing the victim, which is a crime under Section 377C of the same law, where it carries a maximum jail sentence of no more than 20 years and flogging upon conviction.

Judge Mabel then posted bail of RM7,000 for both charges with two guarantees and also ordered the defendant to surrender his passport as well as report to the nearest police station until the case is finalized.

He also warned Dinesh Kumar not to harass the victim or witnesses involved in the case before setting the next citation on December 22, pending medical and chemical reports.

Meanwhile, in Magistrates Court, Dinesh Kumar was also charged with allegedly using force to extort money from the victim at the same place and date around 7 am.

He allegedly committed the crime under article 385 of the Penal Code, which carries a prison sentence of no more than seven years or a fine or flogging upon conviction.

The defendant was also charged with allegedly causing harm to the victim by hitting her face in the same place and on the same date around 5.30 am, which is a crime under Section 323 of the same law.

The offense carries a jail term of not more than one year, or a fine of not more than RM2,000, or both upon conviction.

Dinesh Kumar was also charged with failing to present identification documents to the police at the same place and date around 6.25pm, which constitutes a crime under Rules 25 (1) (a) of the National Registry Rules of 1990.

The offense carries a maximum prison sentence of not more than three years, or a fine of not more than RM20,000, or both upon conviction.

It was also alleged that the defendant had provided false information to the National Registry Department at the Interior Ministry Complex here at around 11:45 am on Sunday (November 15), which is a crime under Section 182 of the Penal Code.

Magistrate Nurasidah A. Rahman then set the amount of bail for the four charges against Dinesh Kumar at RM12,000.

Meanwhile, in the same court, Dewi Riskasari Sutardi, 25, and Salwani Yusof, 28, who were friends of the victim, also pleaded not guilty for causing him harm on the same date, place and time.

Salwani was also charged with failing to present identification documents to the police in Larkin here at around 4:20 pm on November 13.

Nurasidah then set bail for Dewi Riskasari at RM3,500 and Salwani at RM4,000 respectively and also on December 22 for the next mention of the case.

Assistant prosecutors Nur Sulehan Abd Rahman and Benedict Choonh Kai Qi prosecuted the case, while attorney Amerpreet Singh represented Dinesh Kumar, while the other two defendants were not represented.
