Three accused of receiving bribes in connection with the Mindef contract

KUALA LUMPUR: Three men, including a high-ranking retired military officer from the Ministry of Defense (Mindef), have been charged in the Court of Sessions here with corruption for a total of more than half a million ringgit in connection with a contract of maintenance.

Lieutenant Kol Che Ahmad Idris, 54; Brig Jen Mohammed Feizol Anuar Ayob, 50 years old; and Lieutenant Jen (right) Datuk Sheikh Mokhsin Sheikh Hassan, 59, pleaded not guilty after the charges were read, separately, before Session Court Judge Sabariah Othman on Tuesday (October 27).

Che Ahmad, who was the head of strategic cyberwarfare, was slapped with five counts of bribery.

He was charged with one count of requesting RM500,000 and a second count of agreeing to receive the sum from the managing director of FEHM Entity Sdn Bhd, Elias Jemadi Tajudin, as an incentive for him to recommend FEHM for the maintenance of the ministry’s intelligence system to through direct negotiations.

From the third to the fifth count, Che Ahmad allegedly received RM50,000, RM30,000 and RM25,000 from Elias for the same purpose.

The crimes were allegedly committed between September 2019 and April 7.

Feizol, who was charged in his then capacity as a military adviser to the Minister of Defense, also faces five charges.

He was accused of corruptly receiving RM10,000, RM50,000, RM30,000, RM20,000, and RM18,000 from Elias between October 30, 2009 and June 24.

The money was said to be an incentive for Feizol to deliver a letter of intent dated September 5, 2018 from FEHM to Mindef on a strategic partnership for the maintenance of the ministry’s intelligence system.

Meanwhile, the former director general of defense intelligence, Sheikh Mokhsin, was charged with seven counts of corruption.

In the first and second counts, he is accused of corruptly requesting and accepting to receive RM1mil from Elias as an incentive for him to approve the recommendation to appoint the FEHM through direct negotiations for the maintenance of the ministry’s intelligence system.

In the third to sixth counts, Sheikh Mokhsin is said to have corruptly received RM70,000, RM26,000, RM100,000, RM70,000 from Elias for the same purpose.

All the crimes were said to have been committed in Havana Club at the Hotel Concorde, an office in Mindef, and HairDoc Medical Publika between June 20, 2019 and June 5.

In another case, Sheikh Mokhsin also faced a seventh charge of receiving RM50,000 from one Syed Omar Syed Mohamad as a reward for appointing Malvus Sense Sdn Bhd for the procurement, supply, delivery, training and certification of a system in the Mindef.

The crime is said to have been committed in Mindef at 2.30 p.m. on June 26.

The charges were framed under Section 16 (a) (B) of the Malaysia Anti-Corruption Commission (MACC) Act 2009, which carries a prison sentence of up to 20 years and a fine of not less than five times the bonus amount, or RM10,000, whichever is greater, upon conviction

Deputy Prosecutors Muhammad Asraf Mohamed Tahir and Nik Isfahanie Tasnim Wan Abd Rahman offered bail of RM 100,000 for each of the defendants, while Assistant Prosecutor Siti Noor Hafizan Zakaria requested an additional RM 20,000 in collateral for Sheikh Mokhsin for the charge. involving Malvus Sense.

The court granted bail of RM80,000 in guarantee for Che Ahmad, RM60,000 for Feizol and RM110,000 for Sheikh Mokhsin.

They were also ordered to hand over their passports to the court.

The case is set for mention on November 27.
