PETALING JAYA: A property developer who was fined 1.5 million ringgit for instigating Tengku Adnan Mansor in land deals did not suffer any injustice after the former minister was conditionally released on corruption charges, a lawyer said.

“He pleaded guilty on his free will and as such the sentence stands,” said N Sivananthan.

The lawyer said this in response to the effect it had on Tan Eng Boon’s conviction and sentence after the prosecution yesterday requested an exoneration that did not amount to an acquittal from Tengku Adanan’s charge to allow the Malaysian Anti-Corruption Commission (MACC) do more research. .

Sivananthan said Tan was likely to have also been given a conditional license if he had claimed judgment.

Assistant District Attorney Julia Ibrahim told the Superior Court that she was not sure how long MACC would need to investigate and that a decision would be made on whether to proceed with the case “after the new issue is resolved.”

The FMT understands that the 71-year-old Tan did not appeal the fine imposed in September last year after the defense and prosecution pleaded guilty before trial judge Mohd Nazlan Mohd Ghazali.

When contacted, Tan’s attorney, Faisal Moideen, declined to comment on the events that took place in the Tengku Adnan case.

Tengku Adnan, popularly known as Ku Nan, is said to have received RM1 million in 2013 from Tan to approve a request from Nucleus Properties Sdn Bhd (now known as Paragon City Development Sdn Bhd) to increase the proportion of industrial parcels of land. at Jalan Semarak, Kuala Lumpur.

The former minister’s trial was delayed for more than a year as Tengku Adnan went to Federal Court to seek to disqualify Nazlan on the grounds of bias and the Covid-19 pandemic outbreak.

Tan was scheduled to be a prosecution witness at Tengku Adnan’s trial.

Meanwhile, lawyer A Srimurugan said that the conditional release granted to Tengku Adnan, who is also the MP for Putrajaya, means that all the proceedings against him have come to an end.

“The prosecution could reinstate the current charge and continue where it left off,” he said, adding that a new charge under any existing criminal law could also be framed against him.

He said the prosecution could drop the current charge and that he does not need to return to court to inform the judge.
