The court discharges Sugu’s assault case after his wife Pavithra dropped the complaint

IPOH: The Court of Sessions here has given a discharge that does not amount to an acquittal (DNAA) to the husband of YouTube sensation S. Pavithra, M. Sugu, for allegedly assaulting her.

Judge Norashima Khalid made the decision after hearing arguments from both the prosecution and Sugu’s lawyer.

Earlier this month, Pavithra sent a letter to the prosecution not to pursue the case, as she had decided to drop the charges against her husband.

Before the decision was made, Pavithra was sworn in on the witness stand before Norashima and said she was voluntarily withdrawing the case, when Deputy Prosecutor Liyana Zawani Mohd Radzi asked if she had been compelled or threatened to do so.

To a question from Sugu’s lawyer, Syahrul Nizam, whether she (Pavithra) agreed that she would not take further action against the case, she answered yes.

“I therefore request that my client be acquitted and released, as the wife has sworn that she will take no further action on the case,” he said.

However, Liyana applied for a DNAA instead, as she said the prosecution had the power to reopen the case if necessary in the future.

Sugu, 29, a former farm worker, is alleged to have assaulted Pavithra, 28, with a mobile phone and sickle, injuring her lips, left cheek and right arm in the parking lot of the Raja Permaisuri Bainun Hospital between 4 pm and 6 pm on July 21.

Sugu was also charged with carrying a sickle around 6 p.m. in the same place and on the same date, and the crime, under Section 6 (1) of the Corrosive and Explosive Substances and Offensive Weapons Act of 1958, establishes a prison sentence. up to 10 years, if convicted.

On the charge of carrying a sickle, Syahrul said he had submitted a letter of representation to the prosecution to examine and review the charge.

He told the court that the application had been submitted because he considered that there were defense merits that the prosecution should consider.

Liyana requested another date, as she said the prosecution needed time to review the request.

Norashima then set October 22 to hear the first performance.
