Former Prime Minister Najib Razak had requested that the 30-day period begin on September 18, the day after his defense attorneys received the appeal records from the High Court.

PUTRAJAYA: The Court of Appeal has granted Najib Razak 30 days to present his petition to appeal against his conviction on seven corruption charges related to RM42 million belonging to SRC International.

This was after Deputy Prosecutor Mohd Ashrof Adrin Kamarul told a three-member bank headed by Has Zanah Mehat that he did not oppose the motion tabled by the former prime minister.

Attorney Farhan Muhammad Shafee, who appeared for Najib, said the motion should be allowed in the interest of substantial justice.

“The motion is allowed in order in terms,” said Has Zanah, who sat with Lee Swee Seng and Nordin Hassan.

In his request, Najib requested that the 30-day period begin on September 18, one day after his defense attorneys received the appeal records from the Superior Court.

Under Rule 65 (1) of the 1994 Court of Appeals Rule, any petition for appeal must be filed within 10 days of notification to the appellant or within as long a period as the court allows.

Najib, who has confirmed an affidavit in support of the motion, said his attorneys received the 112-volume appeal records and the 801-page ruling on September 17.

“It is impossible to prepare a complete and concise appeal petition to address all the important issues that were dealt with by trial judge Mohd Nazlan Mohd Ghazali,” he said.

On July 28, Nazlan sentenced Najib to 12 years in prison and ordered him to pay a fine of 210 million ringgit after ruling that the latter was guilty of abuse of power, criminal breach of trust and money laundering.

Nazlan allowed Najib’s request to suspend the jail sentence and fine, but the former prime minister was asked to post bail of RM2 million, which he did.

Meanwhile, case management has been set for October 2.
