Technician is the first to be charged under Penang’s Drunk Driving Law

GEORGE TOWN: A 21-year-old computer technician was charged in Magistrates Court today with riding his motorcycle under the influence of alcohol under more severe penalties provided by the recently amended Highway Transportation Act of 1987.

Saw Yen Yew of Sungai Ara is charged with committing the crime on Tun Dr Lim Chong Eu Highway here at 2.55am on Sunday.

You pleaded not guilty to the charge under Section 45A of the Act of driving or being in charge of a motor vehicle with an alcohol concentration above the prescribed limit.

Prosecutor Insp Erma Yanti Abdul Rahim asked the court to set bail of RM8,000 in view of the seriousness of the crime.

Saw’s attorney, Mohd Ismail Mohamed, asked for a lower bond as it was his first alleged crime. Judge Rosnee Mohd Radzuan posted a bond of RM10,000 with a bond and set November 27 for case management.

The amended Road Transport Act carries a maximum fine of RM30,000 and two years in jail upon conviction, compared to a fine of between RM1,000 and RM6,000 and a maximum of 12 months in jail before.

Saw is believed to be the first to be prosecuted under the amended Act in Penang since it took effect last Friday.
