PETALING JAYA: Sentencing in the case of two company directors, including a “Datuk” that was filmed, in a viral video, assaulting a couple at a hotpot restaurant was postponed until May due to a new development in the case. .
The Magistrates Court heard that the restaurant owner had retracted a police report against Datuk Tan Wai Khan, 42, who had previously sought trial on a mischief charge under Section 427 of the Penal Code.
Tan’s attorney, Datuk Suraj Singh, who represented Tan and co-defendant Ang Mow Loong, 40, informed the court that the defense received information that the restaurant owner retracted on the particular offense.
According to the charge under Section 427, Tan allegedly broke plates and bowls belonging to Kwan Pei Chong, 31, at Restoran Steamboat TST, Tropicana Avenue, Damansara, at 9 p.m. on January 12.
He faces a maximum of 12 months in jail or a fine or both, if convicted.
Due to the new development, Suraj asked the court to give the prosecution some time to study the charge and asked for another date for the mention of the case.
“We hope that the relevant document can be delivered before a decision is made on the case,” he said when the case was brought before Judge Nurshahira Abdul Salim here on Friday (April 2).
Deputy Prosecutor Athifah Hazimah Wahab told the court that the prosecution would await further instructions related to the mischief charge.
Magistrate Nurshahira set May 11 for all charges facing Tan and Ang to be re-mentioned.
On January 21, Tan and Ang were jointly charged with willfully causing harm by beating Kwan at the stew restaurant under Section 323 of the Penal Code.
The charge carries a maximum penalty of one year in prison or a fine of up to RM2,000 or both, upon conviction.
For the second count, they were jointly accused of causing public nuisance to customers and employees of the same restaurant, at the same place and at the same time.
The charge under Section 290 of the Penal Code carries a maximum fine of RM400, upon conviction.
They pleaded guilty to the charges.
Tan also pleaded guilty to two counts under Section 323 of the Code of willfully causing harm by striking two more victims, Magdalene Wong Chung Yi, 31, and Lee Dek Quan, 25, at the same place and time.
Tan, however, did not plead guilty to the damage charge.
Tan is currently free on a bond of RM10,000 on a bond, while Ang is free on a bond of RM4,000 on a bond.
