KUALA LUMPUR: A woman claiming to be the wife of the former MIC president, S Samy Vellu, has filed a new request to intervene in S Vell Paari’s lawsuit for the courts to determine her father’s mental health.
Attorney RSN Rayer, representing 59-year-old Meeriam Rosaline Edward Paul, said the application was filed on September 22.
“Previously, Rosaline’s request to intervene in the Vell Paari lawsuit was rejected by the court. So she filed a new application and the court has set October 8 to hear the application, “she told reporters after handling the case before Deputy Secretary Idamasliza Maarof on camera today.
Attorney Tina Ann Francis was also present, representing Vell Paari.
On September 11, High Court Judge Wong Chee Lin rejected Rosaline’s first offer to intervene in Vell Paari’s lawsuit and ordered her to pay a cost of RM5,000 after hearing arguments from both parties.
On the same day, the judge admitted a request by Vell Paari for his father to undergo a mental health examination.
The request was made by Vell Paari in the lawsuit he filed against Samy Vellu for the court to declare that his father was incapable of handling his own affairs.
Vell Paari, 58, filed the lawsuit against Samy Vellu on December 2 of last year, seeking a court order for an investigation to be carried out to determine his father’s mental aptitude and whether the former Minister of Labor has the capacity to manage himself and his affairs.
Vell Paari requested that a date, time and place be set for an investigation to be carried out pursuant to Article 52 of the Mental Health Act 2001 on his father, in order to determine the period in which he had been suffering from mental disorder.
He also applied for a court order to find out whether his father is capable of ordering his lawyer to act on his behalf and to determine the types of property his father owns.
In the event that it is determined that Samy Vellu suffers from a mental disorder and is unable to manage himself and his affairs, Vell Paari wants several people, including himself and lawyer C Vijaya Kumar, to be appointed by the court as members of the committee to administer the defendant’s estate. .
Vell Paari said that since 2017, he had helped his father manage his affairs and wealth and had used his own funds for that purpose, as his father was unable to access the funds in his bank accounts for health reasons.
