KUALA LUMPUR: PKR has yet to deliver the RM 10 million lawsuit to its former Vice President Zuraida Kamaruddin for allegedly violating an agreement linking her to the party.

PKR’s lead attorney, William Leong, said the court was told the plaintiff was unable to serve the subpoena both at her office and at her home.

“On November 16 the case management was further arranged,” Leong said via WhatsApp after the matter came up for case management before Deputy High Court Clerk Nor Afidah Idris.

Leong said the plaintiff had sent Zuraida a request by certified mail for her to appoint and instruct a law firm to accept the service on her behalf.

“We are now in the process of making an appointment with her to accept the service. The next case administration date is to update the court on the progress of the case and seek further instructions on the allegations, ”he said.

The lawsuit was filed by PKR Secretary General Saifuddin Nasution Ismail on behalf of the party on October 2, alleging that Zuraida, who is also a minister of housing and local government, had signed the bond on April 25, 2018, stipulating that He would pay RM10 million for PKR if he left the party after disputing his ticket.

The party claimed that on February 24, Zuraida, along with 10 other PKR MPs announced their resignation from the party without leaving their seat and subsequently formed a new bloc known as Perikatan Nasional (PN) with other opposition parties, including Barisan Nasional, PAS and Gabungan Parti Sarawak (GPS).

PKR said that the federal government led by Pakatan Harapan (PH) was overthrown by PN, which saw the accused be appointed minister.

On the same date (February 24), PKR claimed that its Central Leadership Council had passed a resolution to strip Zuraida of his party membership with immediate effect and issued a certificate dated July 24 confirming the termination of his membership. .

On August 7, PKR claimed that, through its lawyers, it had issued a demand letter demanding that Zuraida pay the sum of RM 10 million in accordance with the terms of the agreement, but the party claimed that the defendant had not paid / refused to pay. the total or partial quantity.

The plaintiff claimed that she was entitled to claim 10 million ringgit from the defendant due to her resignation as a party member, but not as a deputy from Ampang, the seat she won on the party’s ballot using the logo, emblem, flag, services and party services. support – had deprived the party of the benefits and advantages of having a deputy in the Dewan Rakyat and being part of the executive government.

The plaintiff said that he relied on Section 71 of the Contracts Act 1950 to establish his right to recover the remuneration and benefits of RM 2,049,459.20 enjoyed by the defendant after being elected party candidate in the 14th general election (GE14) as Ampang. MP.

As such, the plaintiff seeks a total of RM12,049,459.20 under Section 71 of the Contracts Act, comprising RM10 million under the bond and RM2,049,459.20 for the remuneration and benefits that the defendant received as MP and minister of housing and government. local under the government of PH, with an interest of 5% per year, as well as other costs and compensation that the court deems appropriate.
