Pejuang goes to court for registration after 4 months of waiting

Pejuang was created in August as an independent party based in Malaysia.

PETALING JAYA: The new Pejuang political party, which was formed more than four months ago, has gone to court to force the Registrar of Companies (RoS) to make a decision on its registration.

He said the request was made at the time of their formation, but there has been no response from the RoS.

In a request for judicial review filed today in High Court, the plaintiff, Acting Secretary General Amiruddin Hamzah, wants the party to register seven days after a court ruling, based on section 7 of the Companies Act 1966 .

Furthermore, he said, failure to make a decision was also against article 10 (1) (c) of the Federal Constitution, where all citizens have the right to form associations.

RoS and its CEO have been named as respondents to the action.

The party wants a statement that the defendants’ action or omission to record it was unreasonable and was done in bad faith.

“Furthermore, Pejuang’s failure to register goes against the principles of legitimate expectation,” he said.

Amiruddin, in his affidavit in support of the request and seen by the FMT, also referred to the registration of the Perikatan Nasional coalition, which was allegedly carried out quickly unlike that of Pejuang.

For judicial review, the applicant must first obtain court authorization before the merits of the complaint can be heard.

Last month, one of Pejuang’s founders, Dr. Mahathir Mohamad, said that to date, he has not received approval from the RoS for the party’s registration, although all the requirements have been met.

He said approval of the party’s registration now depends on the minister in charge.

“We have met all the conditions required by the government, but the decision (approval) has to be referred to the minister,” he told a press conference when asked to comment on the state of Pejuang, which was formed in August.

RoS is a unit under the Ministry of the Interior and the minister is Hamzah Zainudin.

Earlier on October 29, Amiruddin said that the party submitted seven requests to RoS but had received no response from RoS even after more than two months.

Pejuang established itself as an independent Malaysian-based party after a faction linked to Mahathir split from the PPBM, which was also founded by the former prime minister.

The other founding members of Pejuang are Mukhriz, the son of Mahathir, who is a deputy from Jerlun; Marzuki Yahaya, Senator; Simpang Rengam MP Maszlee Malik (who is no longer with Pejuang) and Sri Gading MP Shahruddin Md Salleh.

Mahathir said the party’s goals were to fight corruption and that other Malaysian-based parties had deviated from their original paths and been swayed by money and power.
