ALOR SETAR: The Supreme Court here today set December 21 for the owner of the Nasi Kandar Salleh restaurant in Napoh, Kubang Pasu, to present his defense in a lawsuit filed by the Kedah Consumers Association (CAKE), according to his lawyer. .

The owner was the index case of the Covid-19 cluster Sivagangga.

Mohammad Zunun Baihakky said he had received a letter from the lawyer representing Nezar Mohamed Sabur Batcha asking for a date to present the defense on behalf of the shop owner.

“So the court set December 21 for Nezar’s lawyer to present the defense. If no defense is made that day, we will ask the court for a default judgment against him, ”he said.

He told reporters this in handling the case in Superior Court here, which was also attended by CAKE Secretary Mohd Yusrizal Yusoff.

On August 13, Nezar was sentenced to five months in prison and fined RM12,000 by the Magistrates Court after he pleaded guilty to four counts of violating the Covid-19 control and surveillance order on July 14 and causing the Sivagangga cluster.

After that, CAKE, on behalf of some 200 merchants and workers in Napoh whose income was affected by the expansion of the Sivagangga group, filed a 1.5 million ringgit lawsuit against Nezar on August 19 in High Court.

According to Zunun, Nezar was released from prison on November 24.
