Najib’s Appeals, 2 Children Over RM1.74 Billion In Unpaid Tax Will Be Heard Together

KUALA LUMPUR: Appeals by former Prime Minister Najib Razak and his two sons over their tax payment, totaling RM1.74 billion, to the Inland Revenue Board (LHDN) will be mentioned the same day in the Court of Appeal.

Najib has to pay an additional 1.69 billion ringgit in tax arrears, while his sons, Mohd Nazifuddin, 37.6 million ringgit and Mohd Nizar, 13.16 million ringgit.

Based on the Court of Appeal list of cases, the three appeals were settled for case management before Deputy Secretary Mohd Khairi Haron on December 16. All three had filed appeals separately.

Najib, 67, Nazifuddin, 37, and Nizar, 42, have to pay the respective amounts to LHDN after the Kuala Lumpur High Court and Shah Alam allowed LHDN to request a summary judgment against them.

A summary trial is when a court decides a case through argument without hearing testimony from witnesses at trial.

The order against Najib and Nazifuddin was issued by the Kuala Lumpur High Court on July 22 and July 6, respectively, while the order against Nizar by the Shah Alam High Court on September 25.

On June 25 of last year, the government, through LHDN, filed the lawsuit against the Pekan deputy, requesting that he pay RM1,690 million in unpaid taxes for the period between 2011 and 2017 with an interest of 5% per year from the date of the trial, as well as the costs and other repairs that the court considers appropriate.

Judge Ahmad Bache, in his judgment, ruled that since the appraisal notice had been duly served on Najib pursuant to Section 103 (2) of the Income Tax Act of 1967, the tax payable under those Additional assessments are due and paid to LHDN.

On July 24 of last year, LHDN filed the action against Nazifuddin alleging that he still had outstanding taxes for the assessment years 2011 to 2017 totaling RM37,644,810.73 as stated in the assessment notice dated June 15. March 2019.

Judge Ahmad Zaidi Ibrahim in his decision, among others, said that LHDN, as the plaintiff, had shown that his claim was clear and obvious, while the defendant (Nazifuddin) did not show merits in his defense statement.

LHDN filed the same action against Nizar requesting the payment of taxes in the amount of RM 13,159,821.94 for the evaluation years 2011 to 2017.

The Judicial Commissioner of the High Court, Julie Lack Abdullah, in her judgment, ruled that the issues raised by Nizar were without merit, unfounded and unreliable.
