KUALA LUMPUR: Malaysia’s Anti-Corruption Commission (MACC) today ruled in its attempt to stay the enforcement of a High Court decision rejecting it for forfeiting a total of RM957,395.65 that was seized from Johor Bahru Barisan Nasional ( BN) and two others.
This followed a High Court decision here dismissing the prosecution’s request for suspension against Johor Bahru BN, its president Shahrir Abdul Samad and treasurer Raihan Baba.
The money was seized by MACC last year as it was allegedly from former Prime Minister Najib Razak and linked to the 1MDB scandal.
Judicial Commissioner Ahmad Shahrir Mohd Salleh dismissed the prosecution’s request after hearing submissions from both parties.
“After studying the applicant’s (indictment) application and considering the submissions, I found that the application did not comply with Section 311 of the Code of Criminal Procedure. Therefore, I discard it, ”he said.
Earlier, MACC Deputy Prosecutor Maziah Mohaidi told the court that the request was filed pending an appeal hearing against the court’s decision to dismiss the prosecution’s request for forfeiture in the Court of Appeal.
Lawyer Syahrul Syazwan Salehin claimed that if the court allowed the suspension request, it would cause the court to reject its own findings by dismissing the forfeiture request.
“Second, it shows that the court approves an action contrary to the law by allowing the defendant’s property to be held illegally,” he said.
On June 9, Ahmad Shahrir dismissed the prosecution’s request to lose the money seized from the three parties.
